TERMS & CONDITIONS

 

1) Estimates, Quotations & Prices

Custom quotes and estimates are good for 30 days and will be re-quoted after 30 days. Prices calculated and/or posted on this website may change from time to time and are subject to change without notice. NextGeneration reserves the right to refuse an order due to errors generated by our web pricing software. In the extremely rare instance of this happening the customer will be notified immediately and never more than 3 business hours of the following business day.

 

2) Accuracy of Specifications

All custom Estimates and Quotations are based on the specifications provided by the client. NextGeneration Printing, Copying & Digital Communication, LLC will re-quote a job at the time of submission if the job does not agree with the specifications on which the estimate or quote is based. All web based pricing is based on the specifications selected by the client on this web site when placing an order. There are no conditions or agreements relating to any order which is not written or not included on this web site and/or written Estimate, Quotation or Invoice.

 

3) Turnaround

NextGeneration Printing, Copying & Digital Communication, LLC indicates its estimated turnaround times in the order entry screen of this web site, based on digital or offset production from the date we receive your press ready file and is calculated on work days of Monday through Friday and excludes Saturdays and Sundays. Holidays and Acts of God such as weather will also affect the turnaround estimates. Files which are not press ready will delay the turnaround time by the number of days it takes to receive a corrected file or have NextGeneration Printing, Copying & Digital Communication, LLC correct the file and receive your signed proof. All orders received before 12:00 Noon Eastern Standard Time will be considered ordered that business day. All orders received after 12:00 Noon Eastern Standard Time will be considered ordered on the following business day. NextGeneration Printing, Copying & Digital Communication, LLC will do everything in its power to produce your job in the estimated time frame, but can not guarantee a specific shipping date. NextGeneration Printing, Copying & Digital Communication, LLC will ship the method selected in your order (Ground, Next Day Air, etc.) but has no control over and does not guarantee delivery by the 3rd party shipping company.

 

4) Payment and Billing

All orders must be prepaid. We accept all major credit cards including American Express, Visa, MasterCard and Discover. If you would like to pay by check, your order will not begin processing until the check has cleared and will cause a significant delay in your order. NextGeneration Printing, Copying & Digital Communication, LLC will not under any circumstances produce any order as COD or give credit terms for web based orders. Your credit card bill will read "NextGeneration Printing, Copying & Digital Communication”, or NextGeneration Printing”, or “Next Generation Printing”.

 

5) Right to Produce

NextGeneration Printing, Copying & Digital Communication, LLC will not reproduce any material with a copyright without signed release in proper form from the copyright holder. NextGeneration Printing, Copying & Digital Communication, LLC is not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. NextGeneration Printing, Copying & Digital Communication, LLC reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. The client guarantees the legal title of all matter submitted to NextGeneration Printing, Copying & Digital Communication, LLC for printing and/or publication.

 

6). Overruns/Underruns

NextGeneration Printing, Copying & Digital Communication, LLC will normally deliver the exact quantity of goods ordered plus a small additional amount at no extra charge. In the case of a variation, the generally accepted trade practice is plus or minus 10%. In the event of an overrun or under run, NextGeneration Printing, Copying & Digital Communication, LLC may bill for the actual quantity delivered prorated on the quantity ordered.

 

7) Electronic Media and Files

NextGeneration Printing, Copying & Digital Communication, LLC is not responsible for damage to or accidental loss of any electronic media supplied by the client and makes no warranties as to archiving or maintaining said electronic media and/or printed files or samples. It is the client's responsibility to maintain a copy of the original electronic files, images, data and samples. NextGeneration Printing, Copying & Digital Communication, LLC has no responsibility for errors on supplied artwork or electronic files or data furnished by the client and is held harmless by the client for any errors on its supplied artwork, electronic files and data. NextGeneration Printing, Copying & Digital Communication, LLC will produce printed jobs from the client’s supplied artwork, electronic files and data and is not responsible for correctness of the artwork, electronic files and data or color matching. The client understands that each output device, analog or digital, will produce a different result and cannot be compared to the clients own output device or computer monitor. All clients’ files are produced by NextGeneration Printing, Copying & Digital Communication, LLC utilizing the latest technology and software applications, production digital presses, high quality ink jet wide format printers and high quality offset presses. NextGeneration Printing, Copying & Digital Communication, LLC will evaluate the client’s digital input, and no claims or promises are made about our ability to output jobs submitted in digital format, and no liability is assumed for problems with said files. Any editing or correction required to utilize client-supplied files will be charged at our current rates, but only after approval has been received from the client.

 

8) Proofs

If requested by the client, NextGeneration Printing, Copying & Digital Communication, LLC will submit digital color proofs for the client's review and approval. Proofs must be returned to NextGeneration Printing, Copying & Digital Communication, LLC with the proof stamp signed and dated or "Revised Proof Required" and signed by the client. Until the proof is returned, no additional work will be performed. NextGeneration Printing, Copying & Digital Communication, LLC will not be responsible for undetected production errors if: Proofs are waived by the client, the work is printed per the client's written proof approval, or if requests for changes are communicated verbally. All requests for changes of any kind must be made in writing to avoid mistakes. Any proof delays turnaround with production turnaround beginning the work day the final signed proof is received by NextGeneration Printing, Copying & Digital Communication, LLC from the client. A minimum shipping charge of $20 will be charged to send a proof via express air shipping

 

9) Changes

All orders are considered in work and in process the moment they are received and cannot be changed. It is understood that the client has prepared, proofed, and priced their order with NextGeneration Printing, Copying & Digital Communication, LLC prior to submission and no cancellation or changes can be made.

 

10) Design Specifications

All design specifications are indicated in the “Help” section of this web site. Files which do not meet these requirements will be rejected. NextGeneration Printing, Copying & Digital Communication, LLC assumes no responsibility for cutting text or images which exist outside our required safe areas and/or submitted files not set up to specifications for resolution, formatting, fonts not embedded or supplied or any other violation of our specifications. Templates for layout of various items are available at no cost in the “help” section of this web site. Please check your files before submitting for print.

 

11) Color Accuracy

It is understood that each output device, analog or digital, will produce a different result and cannot be compared to the clients own output device or computer monitor. Because of these differences, a "pleasing color" variation between color proofs, clients output on its own device or appearance on clients computer monitor and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance. NextGeneration Printing, Copying & Digital Communication, does not guarantee an exact color match to the art work or electronic files submitted. Depending on whether offset or digital printing is ordered, NextGeneration Printing, Copying & Digital Communication, LLC may convert the color mode to CMYK or RGB possibly resulting in color shift. NextGeneration Printing, Copying & Digital Communication, LLC is not responsible for any color shift. 12) Right to Subcontract

NextGeneration Printing, Copying & Digital Communication, LLC shall have the right to assign any portion of the work required to another contractor.

 

13) Workmanship Guarantee

NextGeneration Printing, Copying & Digital Communication, LLC guarantees all orders to be free of defects in workmanship. If any order does not match the generally accepted trade standards, we will reprint the order or issue the client a refund at our discretion.

 

14) Samples and Electronic Samples

NextGeneration Printing, Copying & Digital Communication, LLC reserves the right to use client’s product for samples for advertising purposes in addition to posting as electronic samples on this web site.

 

15) Cancellations

All orders are considered as work and in process the moment they are received and cannot be cancelled. It is understood that the client has prepared, proofed, and priced their order with NextGeneration Printing, Copying & Digital Communication, LLC prior to submission and no cancellation or changes can be made.

 

16) Shipping/Shipping Methods

Due to our quick turnaround, shipping methods selected by the client when ordering on this web site are final and cannot be changed once the order is submitted. We can not upgrade or change the shipping method that was selected by the client when placing an order. NextGeneration Printing, Copying & Digital Communication, LLC will not use any other form of shipping that is not one of our pre-determined shipping options.

 

17) Delivery

NextGeneration Printing, Copying & Digital Communication, LLC is not responsible for delays and/or damage incurred during shipping. Title for finished work passes to the client upon delivery to the carrier at shipping point; or upon written notification to client that certain items of a multiple item order are completed and are only awaiting completion of the other items for shipping.

 

18) All Sales Final

Since each job is custom created for its owner, it can not be reused or resold.

 

19) Claims

Claims for defects, damages, or shortages must be made by the client in writing no later than 10 calendar days after delivery. If no such claim is made, NextGeneration Printing, Copying & Digital Communication, LLC and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that NextGeneration Printing, Copying & Digital Communication, LLC's performance has fully satisfied all terms, conditions and specifications. In case of dispute, all products will be returned to NextGeneration Printing, Copying & Digital Communication, in order for us to fully inspect the alleged defects.

 

20) Liability

NextGeneration Printing, Copying & Digital Communication, LLC’s liability shall be limited to the stated selling price to the client of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. NextGeneration Printing, Copying & Digital Communication, LLC warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. NextGeneration Printing, Copying & Digital Communication, LLC makes no other warranty and no actions or words of NextGeneration Printing, Copying & Digital Communication, LLC or its officers, employees or agents shall constitute a warranty.

 

21) Indemnification

The client represents that it has the legal right to produce all printed materials ordered from NextGeneration Printing, Copying & Digital Communication, LLC. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against NextGeneration Printing, Copying & Digital Communication, LLC based upon, relating to or arising from the alleged wrongful acts of the clients, or alleging that the printing performed or product produced by NextGeneration Printing, Copying & Digital Communication, LLC ordered by the client: (a) infringes any copyright, patent or other proprietary right of any person; or (b) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the client shall indemnify and hold NextGeneration Printing, Copying & Digital Communication, LLC harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1) defending NextGeneration Printing, Copying & Digital Communication, LLC against any such Claim (2) paying any judgment or award against the client; and (3) reimbursing NextGeneration Printing, Copying & Digital Communication, LLC for any legal fees and expenses it reasonably incurs in responding.

 

22) Disputes & Venue

For legal purposes, the venue for any dispute shall be Seminole County, Florida, USA

 

23) Changes

NextGeneration Printing, Copying & Digital Communication, LLC may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was last revised on January 2, 2009.
